Immediate Actions During Crisis

Within 24 Hours

  • Secure your passport if employer is holding it (contact police if refused)
  • Withdraw accessible salary/savings from company accounts

  • Inform family in Sri Lanka of situation

  • File formal complaint with Ministry of Labor
  • Register with embassy for assistance tracking

Within 1 Week

Your Rights When Employer is Non-Responsive

Important: Employer non-responsiveness does NOT void your rights. Labor authorities can proceed without employer cooperation.

What You Can Do:

File Complaint Anyway

Labor department will attempt to contact employer. If they fail to respond, case proceeds in their absence.

Request Visa Transfer

If unpaid for 60+ days, you may be eligible for visa transfer to new employer without current sponsor consent.

Seek Court Order

Labor court can issue judgment and freeze company assets even if employer doesn't appear.

Embassy can escalate to higher authorities and assist with diplomatic pressure.

Company Closure or Bankruptcy

Act Fast - Time is Critical

When a company closes or declares bankruptcy, workers' salary claims are prioritized, but you must file quickly before assets are liquidated.

Priority Actions:

  1. File Labor Complaint Immediately - Don't wait for company to contact you
  2. Register as Creditor - In bankruptcy proceedings, register your salary claim
  3. Attend All Hearings - Your presence strengthens your claim
  4. Join Collective Action - Multiple workers filing together have stronger position
  5. Monitor Asset Liquidation - Worker salaries are paid from company assets
Priority Order for Payment:
  1. Worker salaries and end-of-service benefits (YOU)
  2. Government fees and taxes
  3. Secured creditors (banks)
  4. Other creditors

This means your salary claim comes FIRST.

Yes, You Can Still Recover Your Money

Even if you return to Sri Lanka, you can continue legal proceedings:

  • Appoint Representative: Authorize someone (friend, lawyer, embassy) to represent you in court
  • Remote Participation: Some courts allow video testimony or written statements
  • Embassy Assistance: Embassy can monitor your case and provide updates
  • Power of Attorney: Grant legal authority to representative to act on your behalf
Success Rate: Many workers successfully recover salaries even after returning home. Don't give up your claim.
